Following a mistrial, the District Attorney's Office is trying a San Jose software engineer for a second time on charges that he shot and killed an attorney.
In 2010 a jury deadlocked 11-to-1 in favor of convicting Jason Cai for the murder of Xia Zhao, who was handling a wrongful death suit against him.
In 2006 Cai was acquitted of murdering his wife who drowned in their swimming pool.
Prosecutors believe Cai feared having to pay hundreds of thousands of dollars in a civil wrongful death suit and that was his motive for the murder of attorney Xia Zhao.
